Officially, a Power of Attorney enacted in one state is valid in any other state. So, a Durable POA signed while a person was a resident of Florida remains valid if the person moves to New York.However, things are seldom as simple as that.In reality, many businesses in New York will not recognize or voluntarily accept an out of state Power of Attorney. Absent a court order, most of them will refuse to recognize its validity. This is partially because of their misapprehension of the laws and partially because of differences between how New York’s legally defined terms of a POA differ from how those provisions are defined in the other state. Again, an estate attorney within the new state would be able to advise you on any specifics you may need.
