More than 15 years back, I was appearing in a CBI case on behalf of an accused person in a Special Court in Mumbai. The examination-in-chief of the accused is required to be conducted by the Special Public Prosecutor in this court. As per law, no leading questions (except trivial questions such as name, address, etc.) can be asked in the examination-in-chief. However, what I noticed in that case was that the judge was having a copy of the police (CBI) statement (recorded during investigation) of the witness before him. The judge was directly asking questions from the witness on the basis of the police statement; then, depending on the reply of the witness, he was dictating the witness statement to his stenographer, and sometimes efforts were willingly or unwillingly made to make such dictated answers to be in conformity with the police statement. What the law requires is that the witness should depose in the court independent of what he stated before police. In fact, under law, his police statement is not signed by him to ensure this.I objected to this procedure being followed by the judge. He said that this is the usual procedure being used in the court and no lawyer objects to it. However, I persisted and politely informed him that what he was doing was a 4-in-1 job. He was judge, prosecutor, police (to some extent) and the witness. I informed him that it is the job of the public prosecutor to ask questions from the witness and not the judge’s job, and also that he should perform his job only of the judge. The judge replied that he was trying to save time. Though he did not like my saying, yet I told him that instead of doing all this, he can directly read the police statements and pass the judgment directly since the trial would in any case be a farce in such situation. My objection was that I can fight with the prosecutor but it would be difficult for me to continuously fight with the judge if he starts performing the role of prosecutor and starts filling in gaps in the investigation by directly reading from the police statement and asking the questions (including leading questions) from the witness, and then on the basis of the answer given dictating them by moulding them (as far as possible) on the lines of the police statement.We had heated arguments for some 20-30 minutes. Initially, he bluntly asked me to challenge the procedure before the high court, if I wanted. However, I kept arguing and explained the requirements of the law, especially relating to the independence of various wings of the criminal justice system (will come back to this topic in a while).Ultimately, the judge agreed and asked the prosecutor to examine the witness. I had done that unpleasant thing at the risk of seriously antagonizing the judge. Over the course of next 2-3 days, I had to make some extra genuine efforts to ensure that he does not become prejudiced against the accused whom I was representing. But, as I later found, that judge was an excellent judge and an excellent person. He used to follow the wrong procedure under misconceived notion that he was saving time by combining roles and also perhaps because he knew that the public prosecutor (as usual, generally) was not professionally competent. Ultimately, in that case, I got acquittal for client. Not only in that case, even in other cases in which I appeared in his court, I got acquittal in favour of the persons I was representing. That judge subsequently became a judge in the Bombay High Court. And, after his retirement from Bombay High Court, he became a judge (judicial member) in a national level tribunal.The purpose of writing this personal experience is to highlight how necessary it is, under our laws, to ensure that police, judiciary, prosecution are independent of one-another. It is a must if we want to ensure real justice in a given case. Let me now explain in brief about the criminal justice system.Criminal justice system in India involves the following institutions:(1) Legislation or law making by Parliament or State Legislature.(2) Police for law enforcement (for crime related laws).(3) Prosecution for conducting trial of cases in courts.(4) Courts for deciding criminal cases.(5) Correction and rehabilitation services, such as jails, rehabilitation centres, etc.All these wings are supposed to be independent of one another; especially police, prosecution and judiciary are supposed to be independent of one another.After 1973, executive magistracy and judicial magistracy were separated from each other. Now, District Magistrate may have some (though not much) control over certain activities of police, but he has no connection with the judicial magistrates. Therefore, whatever little direct or indirect connection that previously existed between police and judiciary (through the District Magistrate), has ceased to exist now.Previously, the prosecutors in the lower (Magistrate) courts were controlled by police department. Now, prosecutors are supposed to be completely independent of the police department.The reason for these different wings of criminal justice system being independent of one-another is to ensure justice and fair play. Otherwise, suppose police and prosecutor work under the same authority then there is a likelihood of them working in tandem to ensure conviction of accused persons involved in various crimes.Likewise, if police starts working directly under the judiciary, then judges are likely to be more sympathetic to the investigation conducted by the police and are not likely to be impartial to the accused persons. A biased mind cannot be independent.It is noteworthy that police derives its powers of investigation mainly under the Criminal Procedure Code (Cr.P.C.). The power to investigate is an independent statutory power of police. Even the courts cannot interfere in the exercise of these powers. The Supreme Court has repeatedly held that courts cannot give specific directions to police to conduct investigation in this way or that way.Of course, it is true that recently, in some high profile cases, the Supreme Court has monitored the investigation (and in some rare cases, the high courts also). They have done so in exercise of the superior powers vested in such courts under the highest law of the land, namely, the Constitution of India and not under the Cr.P.C. But, even in these cases, monitoring by Supreme Court generally does not mean giving specific direction to investigate in one way or another. Such monitoring is in the form of seeking periodic reports of investigation (to let police know that court is watching their investigation), keeping political executive out of such cases’ investigation, etc.But, as far as lower courts are concerned (i.e., District Courts and Magistrate courts), they do not have even such limited powers of monitoring the investigation.It is of utmost necessity that investigation is done by one agency, the prosecution is conducted by another agency, and the job of judging the case and its evidence is done by yet another agency, namely, the judiciary.If you combine one role with another, or bring one agency under the direct control of another agency, then it is the justice that is compromised.Of course, in a way the actual actions of the police by way of investigation are ultimately scrutinized by the judiciary, at the time of arrest, custody, trial, recording of evidence, etc. But, there is no direct control of judiciary over police. And, there should not be any such control. As I mentioned above, the Supreme Court has repeatedly held that police has its independent statutory powers of conducting investigation in criminal offences.Lastly, let me also point out that though police department works under the executive (including the political executive), in so far as investigation is concerned even the executive cannot have any control over police, under the provisions of law, such as Cr.P.C. Such executive may only have administrative control over police officers, but not operational control over the investigation. It is a different matter that in some cases, politicians still manage to control investigation (such as against their opponents or other influential persons) in one way or another through some pliant police officers. But, law is clear: police has independent statutory powers of investigation.
