Ledyard, NY town clerk Rose Marie BelfortiThe civil disobedience perspective presented by Quora member Colin Jensen is interesting.  This was an important public issue with the underground railroad for escaped slaves prior to the Emancipation Proclamation.  Syracuse, New York where I grew up was a major way station for many escaped slaves, and many Syracusans refused to participate in the return of slaves, even after the U.S. Supreme Court ruled clearly mandating such returns.  Typically in these type cases, defendants get the best lawyer they and any supporters can afford, and do their best to minimize the legal consequences, and publicly expose the law's injustice.For myself, if this was her motivation I applaud her activist spirit, if not the values that prompted her action.  In the details of the actual case involved here,  Rose Marie Belforti, the Ledyard, NY town clerk is an elected official in a rural county who cited her religious objection to issuing the license to a lesbian couple.  An opportunity was provided to come back and obtain a marriage license with an assistant's signature at a later time, and the town and Ms. Belforti have since passed the duty of issuing the licenses on to this assistant.  One of the couple was a lawyer and they were sufficiently offended that they threatened to sue the town if the elected clerk in question did not personally issue the marriage license. (http://www.syracuse.com/news/ind...)Katie Carmichael (left) and Deirdre DiBiaggio tried last month to obtain a marriage license from a town clerk in Cayuga CountyFrom  the limited information I have, it seems quite possible that the clerk Belforti (incorrectly) believed she had the right to not personally issue the because of her religious beliefs.  While this is something the New York courts will need to sort out, I do not believe pure motivations, ignorance of her legal duties, or performing acts of civil disobedience obviates one from civil or criminal consequences.  Regarding the details of Ms. Belforti's moral culpability, I must defer here to an insightful letter to the editor written by Adam Kimball to the main morning regional paper, the Syracuse (NY) Post Standard.  Mr. Kimball writes, "Since Belforti claims the Bible as the source of her objection to gay marriage, she must surely be aware that the Bible also calls the marriage of previously divorced people adultery and an “abomination.” If she has refused such a license, then her consistency is to be respected, but it would seem to me that she, along with the other dissenting clerks, are cherry-picking their commandments and claiming religious objections to justify their own personal prejudices."  (http://www.syracuse.com/news/ind...)I don't share Mr. Kimball's conclusion that clerk Belforti is necessarily duplicitous if she had earlier issued marriage licenses to previously divorced individuals, as internal inconsistencies are commonplace among we humans.  I do think that now that this has been pointed out that she would have some moral accounting to do with both the public and herself.
