Most of the time, you just flat can’t know.I was at an airport bar recently (I spend way too much time in airports) and an older couple got to chatting with me while we waited for our flight to Seattle. The couple was convinced of two really amusing things:I was in my 20s. The number of comments about ‘when I get to be older’ coming from a couple about 12 years my senior was hilarious.That my ‘biological clock’ would start ticking if I hadn’t gotten around to having kids by the time I hit my 30s.I didn’t have the heart to tell them that I’m about to hit my 40s… or that I’m trans. I just let drop that my wife and I had been married for over 10 years at this point and that if we hadn’t had kids by now it wasn’t going to happen. Bless their hearts, they let me know that we ‘still had options’ if either of us wanted to get pregnant.Pretty clearly they had no idea that I’m trans. Yay, go me. Conditional passing privilege and all that.Other times, people make it clear that they know I’m trans. When I’m moving in LGBT areas, especially if it’s anywhere I have to fill out a form, when I tell people my name is ‘Jae’ they think I said that my name is ‘Jay’ and they double check for my ‘preferred name’ and reassure me that I don’t have to use my legal name. My legal name is ‘Jae’, I don’t have a ‘preferred name’ my name is ‘Jae.’ That’s a privilege of being transitioned as opposed to transitioning. My ducks all line up.In a way, it’s ironic. From people who don’t have a clue what kind of language to use around transgender people (I don’t just spend too much time in airports, I spend too much time in airports to tiny conservative towns with tiny 3 terminal airports) … I get the most gender affirming treatment. They correctly assume my pronouns and treat me like a woman and it’s no big deal. From people who know more about transgender folk, my trans status gets active attention in a way that is a bit othering.It’s the world we live in, imperfect in its attempts to put a tremendous swath of human diversity into boxes that our minds can easily grasp. Sometimes you know that people think of you as specifically cisgender or transgender… most of the time though, you won’t have a clue. I’ve often wondered ‘does the cashier at the grocery store know that I’m trans and call me ‘ma’am’ because she’s being polite, or does she not know that I’m trans?’ And really, does it matter?Personally, I try not to waste too much mental energy on what other people think but don’t say to me. I have enough to deal with on the things people do actually say, I don’t need to borrow more worry.

Ledyard, NY town clerk Rose Marie BelfortiThe civil disobedience perspective presented by Quora member Colin Jensen is interesting.  This was an important public issue with the underground railroad for escaped slaves prior to the Emancipation Proclamation.  Syracuse, New York where I grew up was a major way station for many escaped slaves, and many Syracusans refused to participate in the return of slaves, even after the U.S. Supreme Court ruled clearly mandating such returns.  Typically in these type cases, defendants get the best lawyer they and any supporters can afford, and do their best to minimize the legal consequences, and publicly expose the law's injustice.For myself, if this was her motivation I applaud her activist spirit, if not the values that prompted her action.  In the details of the actual case involved here,  Rose Marie Belforti, the Ledyard, NY town clerk is an elected official in a rural county who cited her religious objection to issuing the license to a lesbian couple.  An opportunity was provided to come back and obtain a marriage license with an assistant's signature at a later time, and the town and Ms. Belforti have since passed the duty of issuing the licenses on to this assistant.  One of the couple was a lawyer and they were sufficiently offended that they threatened to sue the town if the elected clerk in question did not personally issue the marriage license.
